Terms of Service

Welcome to BuyFrens. These Terms of Service ("Terms") govern your access to and use of the BuyFrens mobile application, website, and related services (collectively, the "Platform"), operated by BuyFrens ("we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 13 years old to use BuyFrens. By using the Platform, you represent that you are 13 years of age or older. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts we believe are held by users who do not meet these requirements.

2. Accounts

To use most features of BuyFrens, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Keep your password secure and not share it with others
Notify us immediately of any unauthorized use of your account
Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. The BuyFrens Platform

BuyFrens is a social group buying platform that enables users to form "squads" and unlock tiered group discounts on products from participating brands. Key features include:

Squad formation: invite friends to join a buying group for a specific product
Group pricing: discounts unlock as squad size increases — specific tiers are shown per product
Order coordination: we facilitate the group order with the participating brand/supplier

We act as a marketplace intermediary. The contract for the sale of goods is between you and the participating brand. BuyFrens is not the seller of record.

4. Orders, Payments & Fees

When you place an order through BuyFrens:

Payment is processed via Stripe. By providing payment information, you authorize us to charge your payment method for all amounts due
Orders are confirmed only when the squad reaches the minimum required size within the deal window — unless otherwise stated
If a squad does not reach its minimum size, orders will not be placed and any charges will be fully refunded
Prices displayed are inclusive of the BuyFrens group discount. Additional taxes or shipping fees may apply and will be disclosed at checkout
BuyFrens charges a service fee (currently 15% of GMV) to participating brands, not to end users

5. Cancellations & Refunds

Cancellation and refund policies vary by brand and product. In general:

You may cancel your participation in a squad order before the deal closes, subject to the specific deal terms
Once an order is placed with a brand, cancellations are subject to that brand's return policy
Defective, damaged, or incorrect items: contact us at support@buyfrens.com within 7 days of delivery for resolution
BuyFrens will mediate disputes between users and brands in good faith

6. User Conduct

You agree not to:

Use the Platform for any unlawful purpose
Create fake accounts or misrepresent your identity
Harass, threaten, or abuse other users
Post spam, fraudulent deals, or misleading content
Attempt to reverse-engineer, scrape, or interfere with the Platform
Use bots or automated tools to interact with the Platform without our written consent
Resell or commercially exploit your BuyFrens account or benefits

We reserve the right to remove content and suspend or terminate accounts that violate these rules, without prior notice.

7. User Content

You retain ownership of content you post on BuyFrens (profile photos, messages, reviews). By posting content, you grant BuyFrens a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating and promoting the Platform. You represent that you have the right to grant this license and that your content does not violate any third-party rights.

8. Intellectual Property

All content, trademarks, logos, and software on the Platform are owned by or licensed to BuyFrens. You may not copy, modify, distribute, or create derivative works from any Platform content without our express written permission.

9. Third-Party Services

The Platform integrates with third-party services (Stripe for payments, Firebase for infrastructure, etc.). Your use of those services is subject to their respective terms. We are not responsible for the actions or content of third-party services.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUYFRENS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO BUYFRENS IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify and hold harmless BuyFrens and its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive your right to participate in a class action lawsuit.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
